IGNITION INTERLOCK DEVICE (IID)

 

WHAT IS AN IGNITION INTERLOCK DEVICE (IID)?

  • IID is an electronic device that installs into your car that requires a breath sample from the driver before the car will start. If the device determines you have alcohol in your system, your car will not start 

 

IS IID INSTALLATION REQUIRED FOR MY DUI?

 

  • Depends.  IID installation will be required for DUI convictions after July 1, 2010 in any of the following counties in California: Los Angeles, Sacramento, Alameda, and Tulare

 

IS IID INSTALLATION REQUIRED IF I WAS CONVICTED OF DUI IN LOS ANGELES?

 

  • Yes.  You will be required to install an IID in your car if you were convicted of DUI in Los Angeles. If you are NOT convicted of a DUI (but instead, only a DUI related violation) you will not be required to install an IID

 

WHERE CAN I GET AN IID INSTALLED ON MY CAR?

 

  • You can get an IID installed by contacting any certified IID installer in California

 

CAN I DRIVE ANYWHERE WITH AN IID INSTALLED IN MY CAR?

  • Unlike a traditional restricted license which only allows you to drive to and from work or for DUI school, you can drive anywhere with an IID installed in your car

 

HOW LONG DO I HAVE TO HAVE AN IID INSTALLED ON MY CAR?

DUI With Injury

  • First DUI: 12 months

  • Second DUI (within 10 years): 24 months

  • Third DUI (within 10 years): 36 months

  • Fourth DUI (within 10 years): 48 months

 

WHAT IF I DON'T OWN A CAR?

 

  • If you don't own a car or have assess to a car, you may apply for an IID exemption within 30 days of your license suspension or revocation notice date

 

HOW CAN I GET MY LICENSE BACK AFTER I FINISH MY IID REQUIREMENT?

  • Pay a $45 ASF fee

  • Proof of Enrollment Certificate Form (DL 107) or Notice of Completion Certificate Form (DL 101)

  • Department of Motor Vehicles Ordered Verification of Ignition Interlock  (DL 924)

  • California Insurance Proof Certificate (SR 22)

  • Pay any applicable reinstatement fees

 

WHAT IF I FAIL TO INSTALL AN IID?

 

  • If you fail to comply with the IID requirements under your DUI conviction and drive with a suspended or revoked license, you can be arrested and your car impounded.  You will be charged with driving on  suspended or revoke license under Vehicle Code §14601. A conviction will result in 2 DMV points and your still have to install an IDD​

HOW MUCH DOES AN IID COST TO INSTALL AND MAINTAIN?

  • Based on the eight most known installation companies, the average cost for an IID installation is $97.00 with average monthly charge of $68.00 per the duration of your monthly term.

[UPDATE: Effective January 1, 2019] CALIFORNIA IGNITION INTERLOCK DEVICE LEGISLATION (SB 1046)

A DMV report issued in June found that for:

  • First DUI offenders: IIDs are 74 percent more effective than license suspension in preventing repeat offenses

  • Second DUI offenders: IIDs are 70 percent more effective than license suspension in preventing repeat offenses

  • Third and subsequent offenders: pilot program IID drivers have a significantly lower odds or hazards of a subsequent DUI conviction and DUI incidents

Based on statistics, California enacted SB 1046, which enables the current pilot program to run for another two years (Alameda, Los Angeles, Sacramento & Tulare Counties).

Starting January 1, 2019, the administrative pilot expands statewide with minor modifications that requires an IID:

  • A First DUI: 6 months with full driving privileges or 1 year restricted license that would allow only driving to and from work if the offender also participates in a treatment program

  • A Fourth DUI: 36 months

The statewide pilot includes an incentive to DUI offenders who choose to install an IID soon after their arrest: They are allowed full driving privileges with installation and use of an IID, and their ultimate IID time requirement is to be reduced based on their early installation of the device prior to conviction (Day for Day credit).

The new law includes an indigent program, 10%, 25%, 50% or 90% of the IID costs depending on the offender's income. The IID provider absorbs the remainder of the cost. The Department of Consumer Affairs (DCA) can impose a $1,000 fine on manufacturers that fail to inform clients of the indigent program or fail to comply with the indigent program.

The new law also requires the California Transportation Agency to conduct a study of the statewide pilot program and submit a report to the Legislature by January 1, 2025. The expanded pilot program ends on January 1, 2026, unless the Legislature extends or modifies it.
